In this assignment I will be show my understanding the process and requirements when working to a brief.
Contractual
A contractual brief is where the Media Company is approached and employed by a client to create and complete a Project for them within the brief and the Media Company must follow the brief. If they complete the project without sticking to the brief then the client can and probably will take the Media Company to court and they will face legal action.
Advantages of a Contractual Brief
The advantages of having a Contractual Brief is The Media Company will know exactly what they need to do and they will know exactly what the client is looking for and the brief will be in lots of detail and possibly go into specifics that the client wants or doesn't want in his project and normally isn't negotiable which the Media Company have to look and take into account specific request that the Client asked
Disadvantages of a Contractual Brief
The disadvantage if this type of contract would be that if the media company think that there are issues within the brief and they produce the product to their own standards this would not be producing the product to the standards set by the client and they could decide to take legal action and this could result in your company having a bad reputation for not completing projects to a set brief.
Negotiated Brief
Negotiated Brief is different to the Contractual Brief. Negotiated Brief is where the Client and the Media Company will come to a specified agreement on the brief of the project given to them and that includes the finalised idea from the Media Company and also the client that employed the media company. It is important the client and the media company both agree on the brief of the project before they start doing anything else so it doesn't cause any problems in the production so that the client can't suddenly change his mind about the agreed final idea and completely change everything.
Advantages of a Negotiated Brief
one of the advantages of Negotiated Brief is that the ideas comes from the Client and The Media Company working together and by that you can merge 2 good idea's and put them both together to generate and really brilliant idea or even 2 bad idea you can possibly merge them together to create 1 good idea. Another advantage is that they can create a brief that is suitable with the Client and the Media Company so there is no arguments or complains from either of them which also means that it's likely fight in future and take each other to court and fight over the legal agreement.
Disadvantages of a Negotiated Brief
One of the Disadvantages of a Negotiated Brief is that Negotiating the brief can sometimes waste time is unnecessary issues are brought up that the client believes do not need to be tackled and this can delay the production time of the product. Another Example of a Disadvantage is one such example is that it can often take a lot of time negotiating which can detract from the amount of time that could be used to produce the end product, this therefore means that a negotiated brief can have longer time scales from start to finish than other briefs. As well as this a negotiated brief can cause issues as the parties may only agree on ideas and not reach a contractual agreement, this means that even longer is taken out of time schedules once they realize that no contract has been formed.
Formal Brief
Formal Brief is when a Production Company is given a brief by a Client that it is detailed and explained what they want you to produce for them. They give you some detail what they want from you but not enough so you can be creative and show them your own creativity to explore with the product as long as still with the brief. The content of this particular Brief is agreed with the Client and the Production Company before and only little details of the product is given and nothing else. Any issues that you have with the brief can be negotiated with the client during the negotiating stages Both the client and the company employed by them will formally agree on the project and the brief but it can not always be legally required. I have some experience with working with this kind of brief from clients for example. Last year in college with Kevin in Digital Graphics we had our own client that we had to produce a poster and a web banner for. Obviously it was unpaid but also myself and a group of friends made a Music Video for a client called David who gave us a brief and he explained in full detail what he was looking for and he said if we had any suggestions and ideas to email him. So i guess it was a mixture between a Formal Brief and a Informal Brief because the brief could change with new good ideas if the idea worked well with what he wanted in the brief that he gave us.
Advantages of Formal Brief
The advantages of a formal brief is the fact of Having this type of brief means that the client is open to any ideas or issues if there are any that could be raised by the media company that is employed, this makes the work quite creative for the media company and there is always room for negotiation or change as long as you ask the client first to make sure he is okay with the idea and changes and let him give you feedback on the idea or comment that you may put forward.
Disadvantages of Formal Brief
The Disadvantages of a Formal is fair because The disadvantages of this type of brief is that the media company may feel that the client has not offered enough information for them to complete the product to the standard that the client wishes. Also the fact that the brief is not always legally binding could bring up problems within the project with things such as financial issues or a breech of contract.
Informal Brief
Informal Brief are different to Formal Briefs and it mostly quite open and basically done face to face mostly through meetings and discussions. but the difference is in comparison because for Informal Briefs there is no written evidence of a brief being agreed at all which means Informal Briefs is mainly is based on trust between the Client and Production Company to uphold on their own agreements and do what they both agreed on and not do what they want without asking if the other party agree with your changes or ideas and not just doing them anyway.
The only notes are made is notes to help them make the product so they know exactly what they want and some ideas what the product is all about before every agrees with one idea and agrees with everything else. During a meeting a handshake or a cuddle may be shared between the clients and the production company to show a bond of trust.
Advantage of Informal Brief have many Advantages and one advantage of a Informal Brief is the fact that there is no string attached and there is no written contract so basically this means that if the Production Company do not uphold their side of the agreement then there is no legal consequences but this is mostly an advantage on the production team because of the fact the Client has no proof of the agreement but it could damage the production company's reputation which is a big thing because it could damage your work because the Client may tell other potential future clients not to go to you because you are not reliable. Also Informal Briefs can be change and new ideas or changes can be implemented into the product whilst in Mid-production which gives the production company more creative freedom and gives them move creativity with the product they are making for the client and it lets the production company the freedom to experiment to use new and different techniques and produce something interesting that the client will enjoy and hopefully like when he sees it. Disadvantages is The fact that there is no written documentation or contract to prove the employment of the company could mean that at the end of the project the client could easily fail to pay their employees. Also this could mean that certain things like deadlines are not completely clear and this can cause confusion for both parties. I have not had any full experience with this but the brief I worked on with my friends was a mixture between Formal and Informal Brief

Informal Brief have disadvantages that can affect both companies involved, Firstly it can be affect because of the fact Informal Briefs are normally verbal brief there isnt really any written document which means if something happens like the production company does not get paid then the company who hired them most likely wont get sued because the production company does not have any written document and it also can caused confusion between all companies that are all involved. Also because it's a verbal brief and not a written brief you may forget about some factors the company who is paying you wants in the film or in the product which may leave them unhappy and it may make the end product not very good.
